PRIVACY STATEMENT BALLET WORKOUT APPLICATION

THIS PRIVACY STATEMENT IS A SUPPLEMENT TO THE BALLET WORKOUT APPLICATION OF BALLET WORKOUT VZW, HEREINAFTER REFERRED TO AS “BW”: A NON-PROFIT ORGANISATION WITH ITS REGISTERED OFFICE AT KLOOSTERSTRAAT 84 BUS 41, 2000 ANTWERP (BELGIUM) AND REGISTERED UNDER NUMBER 0669.918.226.

BW considers the protection of the privacy and personal data of its Users to be one of its foremost priorities. BW is responsible for the processing of this personal data via its Website or the APP. BW shall undertake to comply with the General Data Protection Act (EU Regulation 2016/679).

  1. PERSONAL DATA PROCESSED BY BW

    BW processes the following personal data in relation to the Users:

    • Information about the User’s computer or mobile device and his/her visits to and use of the Website or APP, including the User’s email address, IP address, operating system, browser type, the time of his/her visit and geographic location

    • Personal data required for the use of the Website or the APP: first name, surname, date of birth, gender, address, email, mobile/landline telephone number, invoicing details

    • Any other information that the User decides to share with BW independently

    If information is provided independently by the User via a form, all fields marked with an asterisk (*) are mandatory for the purposes for which they are processed. All other fields can be completed to facilitate the services provided by BW.

    Users will only be able to use the APP through a functioning internet connection. Additionally, Users are required to give their consent to the processing of their personal data via the internet (“INTERNET PERMISSION”).

    The name and profile photograph of the User can, if desired, be recognised automatically when the User logs in via Facebook or other social media. The User grants his/her consent for the APP to retrieve information from other folders or the media of a device for the purpose of installing such items as a profile photograph (“FILE MEDIA ACCESS PERMISSION”).

  2. OBJECTIVE OF THE PROCESSING

    BW processes Users’ personal data for the following purposes:

    1. To enable the Users to use the APP

    2. To improve the content and user-friendliness of the APP and the Website

    3. User management

    4. Bookkeeping and invoicing

    5. To personally inform Users about its calendar or changes therein

    6. To personally inform Users about products or services

    7. To personally inform Users about products or services offered by Promoters

    Users’ personal data may be disclosed to the Promoters affiliated with BW for one or more of the purposes listed above. BEFORE PERSONAL DATA CAN BE USED FOR OBJECTIVES E, F AND G ABOVE, A MESSAGE WILL APPEAR TO EXPRESSLY ASK THE USERS FOR THEIR CONSENT (“PUSH NOTIFICATION PERMISSION”).

    The above provision does not detract from BW’s right to place general advertisements on the Website, whether for the benefit of BW or third parties, without prior warning.

    IF THE PROCESSING IS BASED ON THE USER’S CONSENT, THE USER WILL HAVE THE RIGHT TO REVOKE HIS/HER CONSENT AT ALL TIMES, WITHOUT PREJUDICE TO THE LEGITIMACY OF THE PROCESSING BASED ON CONSENT PRIOR TO THIS CONSENT BEING REVOKED.

  3. TRANSFER OF YOUR PERSONAL DATA

    BW makes Users’ personal details available to its personnel on a need-to-know basis.

    BW may use processors to process Users’ personal data. BW transfers personal data to the following recipients and categories of recipients:

    • Processors that provide statistical research and analysis services

    • Processors that provide hosting services for this Website and the APP

    • Processors that are Promoters of BW

    • Organisations that provide payment processing services

    • Organisations with which BW has a statutory obligation to share personal data

    BW reserves the right to transfer personal data to any and all affiliated companies wishing to take over the activities of BALLET WORKOUT.

  4. RETENTION OF PERSONAL DATA

    BW shall undertake to refrain from retaining Users’ personal data for any longer than for the purposes defined above.

  5. YOUR RIGHTS

    THE USER HAS THE RIGHT TO CONSULT HIS/HER PERSONAL DATA. THE USER ALSO HAS THE RIGHT TO (I) REQUEST THE CORRECTION OF HIS/HER PERSONAL DATA AND (II) THE DELETION OF HIS/HER PERSONAL DATA. ADDITIONALLY, THE USER HAS THE RIGHT TO OBJECT TO THE PROCESSING OF HIS/HER PERSONAL DATA FOR ADVERTISING PURPOSES.

    Users wishing to exercise their rights as listed above can contact BW at the following email address: info@balletworkout.be. BW will inform the User of the outcome within one (1) month after the request has been submitted. The User also has the right to lodge a complaint with the Belgian Supervisory Authority (Gegevensbeschermingautoriteit, Drukpersstraat 35, 1000 Brussels, Belgium).

  6. COOKIES

    YOU MAY REJECT COOKIES VIA YOUR BROWSER SETTINGS. THIS MAY HAVE AN ADVERSE EFFECT ON THE OPERATION OF SPECIFIC COMPONENTS OF THE WEBSITE.

    BW uses cookies to facilitate the use of the Website. Cookies are files that a web server sends to the User’s computer, which allows the computer to be identified for the duration of the session. Most browsers have been set to automatically accept these cookies. The User may, however, deactivate the retention of cookies or adjust the settings of his/her browser in such a way that he/she will receive notification prior to the cookie being installed (or not installed) onto his/her computer.

    BW uses the following types of cookies:

    • Third-party cookies: cookies that are installed by websites outside of the BW domain, which the user has visited and that are displayed in the address bar of the browser (‘frequency capping cookies’, cookies from advertisement networks, cookies for market research and analysis, advertising cookies from third parties and cookies from Google Analytics).
